Terms of Use
Last updated: July 2026
This document is not yet available in your language. The English version is shown.
The German version is authoritative. Translations are provided for convenience.
Only upload photos you hold the rights to and that the people shown are comfortable with. Anything unlawful has no place here. Break these rules and you lose access.
1. Who we are and what these terms cover
The provider of Calfira is Ali Makhloufi, Bergiusstr. 7, 40880 Ratingen, Germany (see Legal Notice). These terms apply to the use of the Calfira app and the website calfira.app.
Calfira is a service for collecting photos of an event together. Whoever creates an event is referred to below as the host, whoever joins as a participant.
By using the service you accept these terms. If you are under 16, you need the consent of your parents or legal guardians.
2. No account, no sign-up
Calfira needs no user account. You join via a QR code or a short access code. Your device is recognised through a random, pseudonymous device identifier.
There is no entitlement to permanent availability. We may change, extend or discontinue the service. If we plan to discontinue it, we will give reasonable notice.
3. What you may upload
You may only upload content
- to which you hold the necessary rights (in particular copyright),
- which the people shown are content to have shared within this group (right to one's own image),
- and which does not breach applicable law.
Photos of children may only be uploaded with the consent of those with parental responsibility.
4. What is prohibited
It is prohibited in particular to upload, send or distribute:
- depictions of the sexual abuse of children and young people, and any child or youth pornographic material
- pornographic or sexualised content
- depictions of violence, incitement to violence and terrorist propaganda
- content or symbols that incite hatred, or that are racist, extremist or unconstitutional
- insults, threats, harassment, bullying and stalking
- recordings that violate the most private sphere of life, such as covert recordings from changing rooms, toilets or bedrooms
- third-party content without the necessary rights
- malware, advertising, spam and chain messages
Also prohibited are automated access to the service, circumventing technical restrictions, mass sending of messages or reports, and any attempt to compromise the security of the service.
5. Reporting content
In every event you can report photos and messages. There are two levels:
- "It bothers me" - the report goes to the host of the event. They decide whether the content is removed. The content stays visible until then.
- "Illegal content" - the content is hidden from everyone immediately and forwarded solely to us as the provider. The host can neither lift nor dismiss this report.
You can also report content outside the app to abuse@calfira.app. Please describe the content, the event concerned and the reason for the report.
The number of reports per device is limited. Repeated baseless reports may themselves lead to exclusion.
6. How we handle reports
We review every report at the "illegal content" level. In doing so we do not conclusively determine whether content is unlawful - we assess whether there is a serious indication. Three outcomes are possible:
- No indication: the content is restored and the case is closed.
- Unclear: the content stays hidden until the case is resolved.
- Serious suspicion: the content stays removed and we pass the case to the competent body.
Where content is reported as illegal, we secure the reported content together with technical details (time, device identifier, IP address, checksum). Details are set out in our Privacy Policy, section 5.
If content of yours is removed or your access is blocked, we will tell you the reason on request, provided we have a way to contact you and no legal grounds prevent it. If you disagree with a decision, you can object at abuse@calfira.app. We will then look at the case again.
7. Measures in the event of breaches
Where these terms are breached, depending on severity we may:
- hide or delete individual items of content,
- block or delete an event,
- exclude a device from the service temporarily or permanently.
In serious cases, in particular where criminal offences are suspected, exclusion takes effect without prior notice. In such cases there is no entitlement to a refund of storage packages already purchased.
Within their own event, the host may additionally remove photos and exclude participants.
8. Rights in your photos
Your photos remain your photos. You grant us only the right to store them for the operation of the service, to process them technically (for example to create thumbnails) and to display them to the other participants of the respective event. This right ends when the content is deleted.
We do not use uploaded photos for advertising, do not pass them to third parties and do not sell them.
9. Storage and purchases
Every event receives free basic storage. If more is needed, a storage package can be purchased. The storage belongs to the event, not to the person who bought it: any participant can contribute, and everyone benefits.
Purchases are handled through Google Play or the Apple App Store. They are one-off purchases, not a subscription. Payment, invoicing and refunds are governed by the terms of the respective store.
Purchased storage is tied to the respective event. When an event is deleted as scheduled, the purchased storage ends with it; no refund is given.
10. Availability, backup and liability
Calfira is not a backup service. Events and their photos are deleted automatically once they expire. Download any photos you wish to keep in good time.
We are liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. For slightly negligent breaches of material contractual obligations, our liability is limited to the typical, foreseeable damage. Liability is otherwise excluded. Mandatory statutory provisions remain unaffected.
Users are themselves responsible for the content they upload. Where you indemnify us against third-party claims arising from content you uploaded, our own obligations remain unaffected.
11. Contact and competent points of contact
General enquiries: info@calfira.app
Reports of unlawful content and complaints: abuse@calfira.app
The German-language address missbrauch@calfira.app reaches the same mailbox.
These addresses also serve as our single points of contact for users and authorities under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). Communication is possible in German and English.
12. Changes and final provisions
We may amend these terms, for example when features change or the legal situation develops. The current version is always available at calfira.app/nutzungsbedingungen.php. Where changes are significant, we point them out inside the app.
German law applies. If any provision is invalid, the remainder stays in force.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
